These Terms of Service (“Terms”) govern your access to and use of our website and the travel-related services provided by F5 Escapes. By accessing or using our website, social-media channels, or any other digital platform operated by us, or by booking a trip, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any provision, please refrain from using our website or services.

1. Scope of Services

F5 Escapes offers travel-related services, including women-only group tours, customised vacation planning, and ground-handling support for partner travel companies. The Services include travel planning, itinerary design, booking, and logistics coordination. All third-party vendors (such as transport operators, hotels, and activity providers) are independent contractors and not employees, agents, or representatives of F5 Escapes.

These Terms apply to all Services offered by F5 Escapes globally, including bookings made by foreign nationals for travel within or outside India.

2. Eligibility and Use Restrictions

These Services are intended for individuals legally capable of entering into binding contracts. By using our Services, you represent and warrant that you are at least 18 years old, possess valid travel documentation, and will comply with all applicable laws. You agree not to use our website or Services for unlawful purposes, to harass others, or to interfere with our systems.

3. Bookings, Payments, and Service Availability
   1. Bookings may be made via our website, email, or authorised representatives. A booking is confirmed only upon receipt of the required payment. Prices displayed are indicative and subject to confirmation. Payments are processed in Indian Rupees (INR), and any bank or conversion fees are borne by the traveler. 
   2. For international travelers, equivalent payments may be accepted in other currencies through authorised payment gateways, subject to prevailing exchange rates and applicable transaction fees.
   3. F5 Escapes may cancel bookings arising from unauthorised or fraudulent transactions. We may modify, postpone, or cancel trips due to operational constraints, safety concerns, or events beyond our control.
   4. F5 Escapes reserves the right to correct any inadvertent errors in pricing or descriptions before or after booking confirmation.
4. Personal Data and Documentation

F5 Escapes collects and processes personal data in accordance with our Privacy Policy. You are responsible for ensuring all personal and identification information provided is accurate and complete.

5. Travel Insurance

F5 Escapes does not provide travel insurance. Travelers are solely responsible for obtaining comprehensive travel insurance covering medical emergencies, cancellations, baggage loss and delays.

Proof of insurance may be requested prior to commencement of travel, and F5 Escapes reserves the right to deny participation to uninsured travelers without liability.

6. Right to Refusal of Service and Discontinuation
   • General Right to Refusal of Service
     • F5 Escapes reserves the absolute right to refuse or cancel service to any individual at its sole and unfettered discretion, either prior to booking confirmation or thereafter, in circumstances including but not limited to:
     • The traveler providing incomplete, false, or misleading information during booking or communication;
     • The traveler’s past or known conduct suggesting potential disruption to group harmony, safety, or trip management;
     • Abusive, threatening, discriminatory, or otherwise inappropriate behaviour directed towards F5 Escapes’ staff, partners, or other travelers;
     • Non-payment, payment disputes, chargebacks, or suspected fraudulent transactions;
     • Violation of any law, regulation, or these Terms of Service; or
     • Any other reason deemed sufficient by F5 Escapes in good faith to protect its business integrity, staff wellbeing, or the interests of other customers.
     • In such cases, F5 Escapes may, at its discretion:
     • cancel or refuse the booking, and
     • refund the amount received after deducting any applicable non-recoverable expenses such as vendor payments, administrative fees, or third-party cancellation charges.
     • Such decisions shall be final and binding, and no correspondence or appeal shall be entertained.
   • Right to Discontinue Participation During a Trip
     • F5 Escapes and its authorized representatives retain the right to discontinue a traveler’s participation in any trip or activity, effective immediately, if the traveler:
     • Engages in illegal, unsafe, or unethical conduct;
     • Consumes alcohol, drugs, or substances in a manner that endangers self or others;
     • Disobeys lawful or reasonable instructions of the trip leader or authorised representative;
     • Harasses, bullies, or otherwise disrupts the peace or comfort of other participants, staff, or local communities;
     • Damages property or acts in a way likely to harm the reputation of F5 Escapes or its partners; or
     • Displays conduct inconsistent with the values of safety, respect, and cooperation expected on F5 Escapes trips.
     • If discontinuation occurs under this clause:
     • the traveler shall forfeit all payments made for the trip,
     • the traveler shall have no entitlement to refund or compensation, and
     • the traveler shall bear all expenses arising from early departure, alternate arrangements, or return travel.
     • F5 Escapes, its representatives, and third-party partners shall not be liable for any inconvenience, financial loss, or damages suffered by the traveler as a result of such discontinuation.
   • Immediate Action and Safety Override
     • F5 Escapes and its authorized trip leaders may exercise the rights under this clause immediately and without prior notice where, in their sole discretion, delay would compromise:
     • the safety, health, or wellbeing of any person;
     • public order; or
     • the orderly continuation of the trip.
     • In all such cases, the decision of F5 Escapes or its representative shall be final, conclusive, and binding on the traveler.
   • Effect of Refusal or Discontinuation
     • The traveler acknowledges that participation in an F5 Escapes trip is subject at all times to compliance with these Terms and to the authority of F5 Escapes and its representatives.
     • Refusal or discontinuation shall not constitute a breach of contract or deficiency of service by F5 Escapes.
     • Any costs incurred by F5 Escapes in facilitating the traveler’s early departure, including transport or accommodation, may be recovered from the traveler.
     • F5 Escapes reserves the right to deny future bookings or participation in its activities to any traveler removed or refused under this clause.
7. Cancellations and Refunds
   • Traveler-initiated cancellations are governed by the policy displayed on the website. Bookings are non-transferable unless approved in writing. Refunds are processed after deduction of non-recoverable costs within 30 working days. In force majeure cases, F5 Escapes may reschedule or refund recoverable costs only.
   • Refunds, where applicable, shall be processed to the original mode of payment only.

8. Disclaimer and Assumption of Risk
   
   1. All Services offered by F5 Escapes are provided on an “as-is” and “as-available” basis. While F5 Escapes exercises due care in planning and executing trips, it makes no representations or warranties, express or implied, regarding the quality, accuracy, reliability, safety, or suitability of any aspect of the Services, itineraries, destinations, or third-party arrangements.
   2. Travel inherently involves risks, including but not limited to personal injury, illness, property loss, delays, changes in schedules, or events beyond human control such as weather conditions, natural disasters, or government actions.
      By booking or participating in any trip or activity, each traveler voluntarily assumes all such risks, including any arising from the acts or omissions of third parties or other participants, and agrees that F5 Escapes, its officers, employees, and partners shall not be held liable for any loss, injury, damage, or expense except as expressly provided in these Terms.
   3. Travelers are advised to make independent assessments of destination conditions, obtain adequate travel insurance, and exercise reasonable caution throughout their journey.
   4. F5 Escapes shall not be liable for the acts, omissions, or negligence of any third-party provider or for events outside its reasonable control.
      
9. User Responsibilities
   1. General Obligations

All travelers are required to conduct themselves responsibly and cooperate with F5 Escapes, its representatives, and other participants to ensure a safe, smooth, and enjoyable travel experience. By booking or participating in a trip, each traveler undertakes to comply with all conditions, instructions, and requirements communicated by F5 Escapes before and during the trip.

2. Documentation and Legal Compliance

It is the sole responsibility of the traveler to ensure possession of all valid and necessary travel documents, including but not limited to:

• passports, visas, travel permits, and other authorizations required for entry, transit, or stay in any destination;
• vaccination certificates, health declarations, and insurance documents, where applicable; and
• any additional documentation required by government authorities, transportation agencies, or accommodation providers.

F5 Escapes shall not be responsible for any denial of entry, deportation, delay, or loss resulting from the traveler’s failure to obtain or maintain valid documentation or comply with immigration, customs, or health regulations.

All travelers are further required to comply with applicable laws, cultural norms, environmental regulations, and health advisories in force at the destination country or region.

3. Accuracy of Information

Travelers must provide complete, accurate, and truthful information during booking and at all times thereafter, including but not limited to:

• personal and contact details,
• medical conditions, allergies, or mobility limitations,
• dietary restrictions or special requirements, and
• emergency contact information.

F5 Escapes relies on such information for the planning, safety, and execution of the trip. Any inaccuracy, omission, or failure to disclose relevant details may result in denial of service or termination of participation without refund.

4. Health, Fitness, and Insurance

Each traveler is responsible for ensuring that they are in suitable physical and mental condition to undertake the activities included in the trip itinerary. By booking a trip, the traveler confirms that they:

1. have consulted with a qualified medical professional, if necessary, regarding fitness to travel;
2. will bring and use any prescribed medication as needed; and
3. have disclosed to F5 Escapes any medical condition, disability, or limitation that may affect participation or require special arrangements.

Travelers are required to maintain valid travel insurance covering at least medical emergencies, hospitalization, accident, loss of belongings, trip cancellation, and travel disruption. F5 Escapes may require proof of insurance before departure. 

F5 Escapes reserves the right to refuse participation or continued service to any traveler who, in its reasonable opinion, is medically unfit to participate or whose condition may compromise group safety.

F5 Escapes shall not be liable for any consequences arising from a traveler’s failure to disclose relevant medical information or to obtain necessary insurance coverage.

5. Behavior and Group Conduct

As elucidated in Clause 6 of these Terms, Travelers are expected to behave respectfully towards:

• fellow participants and trip leaders in group tours;
• local hosts, vendors, and community members; and
• the environment and property of others.

The following behaviors are strictly prohibited and may result in immediate removal from the trip without refund:

• harassment, bullying, or verbal or physical abuse;
• possession or use of illegal drugs or substances;
• excessive consumption of alcohol that disrupts group harmony or safety;
• theft, vandalism, or wilful damage to property;
• disregard for local customs, culture, or environmental sensitivities; or
• refusal to comply with lawful or reasonable instructions of F5 Escapes’ representatives or guides.

Any traveler removed under this clause shall bear all costs associated with early departure, including transport, accommodation, or alternative arrangements.

6. Safety and Cooperation

1. Travelers must follow all instructions issued by trip leaders, guides, or representatives of F5 Escapes.
2. They must exercise caution, adhere to safety protocols, and use equipment responsibly during activities such as treks, safaris, adventure excursions, or other experiences facilitated by F5 Escapes.
3. F5 Escapes shall not be liable for any injury, loss, or damage arising from the traveler’s failure to follow instructions or exercise reasonable care.
   Travelers are also expected to promptly report any incident, health issue, or safety concern to F5 Escapes’ representatives during the trip.
4. Consequences of Non-Compliance

Failure to comply with any of the obligations set out in this clause may, at the discretion of F5 Escapes or its authorised representatives, result in:

• denial of participation in the trip or any part thereof;
• immediate removal from the group; or
• refusal of future bookings.

In such cases, the traveler shall not be entitled to any refund, compensation, or claim, and all additional costs incurred as a result of non-compliance shall be borne solely by the traveler.

10. Jurisdiction and Cross-Border Bookings
    • All bookings made with F5 Escapes are deemed to be executed in Bengaluru, India, irrespective of the customer’s country of residence, place of payment, or location at the time of booking. These Terms, and any dispute or claim arising out of or in connection with them, shall be governed exclusively by the laws of India, without regard to conflict-of-law principles.
    • Foreign consumer-protection laws or jurisdictional provisions of any other country shall not apply to the Services provided by F5 Escapes. By making a booking, each traveler acknowledges and agrees that the relationship between the parties shall be governed solely in accordance with Indian law.
    • In the event of any inconsistency or conflict between these Terms and any information contained in marketing materials, itineraries, or other correspondence, the provisions of these Terms of Service shall prevail.
    • All transactions, communications, and agreements with F5 Escapes shall be deemed to have been made and concluded in Bengaluru, India.
11. Dispute Resolution and Arbitration
    • In the event of any dispute, controversy, or claim arising out of or in connection with these Terms, the Services provided by F5 Escapes, or the interpretation, performance, or termination thereof, the parties shall first make good faith efforts to resolve such dispute amicably through mutual discussions and negotiation within thirty (30) days from the date on which either party provides written notice of the dispute to the other.
    • If the parties are unable to reach an amicable resolution within the said period, the dispute shall be finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, and any statutory modification or re-enactment thereof for the time being in force.
    • The seat and venue of arbitration shall be Bengaluru, Karnataka, India.
    • The arbitration proceedings shall be conducted in the English language.
    • The arbitral award shall be final and binding upon both parties, and may be enforced in any court of competent jurisdiction.
    • Each party shall bear its own costs of arbitration, unless otherwise directed by the arbitral tribunal.
    • All arbitration proceedings, pleadings, documents, and information exchanged between the parties shall remain strictly confidential, and shall not be disclosed to any third party except as required by law or for enforcement of the arbitral award.
    • For any matters that are not subject to arbitration, or for the purpose of interim relief or enforcement of an award, the courts at Bengaluru, India, shall have exclusive jurisdiction.
12. Limitation of Liability
    • F5 Escapes acts solely as a facilitator and intermediary between travelers and independent third-party service providers such as airlines, hotels, transport operators, and local partners.
    • While reasonable care is taken in selecting and coordinating with such providers, F5 Escapes does not own, operate, or control them, and therefore shall not be liable for any acts, omissions, errors, or defaults of third parties, including any injury, loss, delay, or damage arising therefrom.
    • F5 Escapes shall further not be responsible for losses, delays, or disruptions caused by force majeure events, government actions, or the traveler’s own negligence, non-compliance, or failure to provide accurate information.
    • To the fullest extent permitted by law, F5 Escapes shall not be liable for any indirect, consequential, incidental, or punitive damages, including loss of enjoyment, profit, or opportunity, even if advised of the possibility of such damages.
    • In all cases, F5 Escapes’ total aggregate liability, whether in contract, tort, or otherwise, shall be limited to the amount actually paid by the traveler for the specific trip giving rise to the claim.
    • Nothing in these Terms shall exclude or limit liability for death or personal injury caused by gross negligence, or any liability that cannot be excluded under applicable law.
13. User-Generated Content and Reviews
    • By submitting or sharing any reviews, testimonials, photographs, videos, or other content (“User Content”) with F5 Escapes, you grant Zingara Solutions Private Limited (operating as F5 Escapes) a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt, publish, display, and distribute such content for promotional, marketing, or archival purposes, across all media formats now known or later developed.
    • You confirm that:
      • you are the rightful owner of the User Content or otherwise authorised to grant this licence;
      • your submission does not infringe any third-party rights, including copyright, privacy, or publicity rights; and
      • all persons depicted in the content have consented to such use.
    • F5 Escapes may edit or adapt the content for formatting or presentation purposes, without materially altering its meaning.
    • You agree to indemnify and hold F5 Escapes harmless against any claims or liabilities arising from or related to your User Content.
    • F5 Escapes reserves the right, but not the obligation, to remove or decline to use any User Content that it deems inappropriate, unlawful, or inconsistent with its brand values

14. Intellectual Property and Website Use
    1. Ownership of Intellectual Property
       • All content, materials, and information appearing on the website https://f5escapes.com — including but not limited to text, itineraries, descriptions, photographs, images, graphics, videos, audio clips, logos, icons, layout, design, databases, software, source code, and any other digital assets — are the exclusive property of Zingara Solutions Private Limited, operating under the brand name F5 Escapes, or are lawfully licensed to it.
         All such materials are protected by applicable intellectual property laws of India, including the Copyright Act, 1957, the Trade Marks Act, 1999, and international conventions on intellectual property.

2. Usage Restrictions

You may access and use the website and its content solely for your personal, non-commercial, and lawful use in connection with planning or booking travel with F5 Escapes.

Without the prior written consent of F5 Escapes, you shall not, directly or indirectly:

• copy, reproduce, republish, download, post, display, transmit, distribute, or otherwise exploit any part of the website or its content in any form;
• modify, adapt, translate, reverse-engineer, decompile, disassemble, or create derivative works from any portion of the website;
• use data-mining, scraping, robots, or similar data-gathering or extraction tools to access or harvest information from the website;

• use any F5 Escapes trademarks, logos, or other proprietary identifiers without prior written authorisation.

3. Trade Marks and Brand Identity

The names “F5 Escapes”, related taglines, and all related graphics, icons, and branding elements constitute trade marks and trade names owned by or licensed to Zingara Solutions Private Limited.
No licence or right to use such marks is granted or implied by mere access to the website. Any unauthorised use constitutes infringement and may lead to civil and criminal action.

4. Proprietary Nature of Itineraries and Content

All itineraries, travel plans, and descriptions of destinations or experiences published on the website or shared with prospective customers are proprietary and curated through F5 Escapes’ intellectual and creative effort. Such content shall not be copied, replicated, or distributed for competing or commercial purposes. F5 Escapes reserves the right to take appropriate legal measures, including injunctions and claims for damages, against any unauthorized use or misappropriation.

15. Amendments and Version Control

F5 Escapes may amend these Terms to reflect operational or legal changes. The current version and effective date appear above. Significant updates may be announced via the website or email.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of India.

18. Emergency Contact Information and Communication
    1. The traveler shall provide the Company with the name and contact details of at least one emergency contact prior to commencement of travel, and shall ensure that such information is accurate and up to date.

2. The Company shall have the right to contact the designated emergency contact in the event of illness, injury, safety concerns, or any other situation in which the Company reasonably believes such communication is necessary for the traveler’s wellbeing. Such contact shall be limited to what is reasonably required to address the relevant situation

3. The Company shall handle the emergency contact details, and any communications made pursuant to this Clause, in compliance with applicable privacy and data-protection laws, and shall use such information solely for emergency-related purposes

19. Force Majeure
    1. F5 Escapes shall not be liable for any delay, interruption, or failure in performance of its obligations arising from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, pandemics, epidemics, government restrictions, strikes, labour disputes, war, civil unrest, terrorism, communication failures, or transport disruptions.
    2. In such situations, F5 Escapes will make reasonable efforts to notify affected travelers and to provide alternate arrangements, reschedule the trip, or offer credits or refunds of recoverable costs, subject to feasibility and third-party cooperation.
    3. F5 Escapes shall not be considered in breach of its obligations or otherwise liable for any loss, damage, or inconvenience resulting from such events, provided it acts in good faith and takes reasonable measures to mitigate the impact on travelers.
    4. Refunds or credits, where provided under this clause, shall be limited to amounts recoverable from third-party vendors.
